š«“Holding Money From Agencies
Hey friend,
I hope this week hasnāt been too rough for you.
I wish I could bring better news, but the Trump administration is exploring actions to block federal agency funding. A move many people argue would be illegal.
OMB Director Russ Vought said that the administration is considering āpocket rescissions,ā a tactic that could allow previously approved funding to quietly expire at the end of the fiscal year, without congressional consent.
Under the 1974 Impoundment Control Act, the president can propose to rescind funding Congress has already approved. Congress has 45 days to respond. If congress doesnāt act in that time, the funding is gone.
The Government Accountability Office has already ruled twice that previous Trump administration attempts to withhold funds were unlawful.
GAO General Counsel wrote that pocket rescissions would be an āabuseā of presidential power, and warned that āno mechanismā exists for a president to change the expiration date of appropriated funds.
The president is currently pushing a $9.4 billion rescission package. The House narrowly approved it earlier this month. It now sits with the Senate, where opposition could block its passage.
Using pocket rescissions could give the administration a backdoor to defund agencies without ever spending the money.
This could impact future hiring and operations.
This is more than a budget fight, itās a potential separation of powers crisis.
šForward with Layoffs
Last month, a judge ruled that State, like most federal agencies, cannot yet proceed with reductions in force (RIFs).
But that hasnāt stopped the department from pushing ahead. On Monday, it quietly rewrote its internal policies, giving itself more power to restructure and reduce its workforce.
Whatās New?
Foreign Affairs Manual Revised: State changed its rulebook to now allow RIFs based on an employeeās post, region, or bureau, reversing previous protections.
Nearly 800 new ācompetitive areasā were created, making it easier for management to target specific units or groups for layoffs.
The department also gave itself flexibility to issue less than the standard 120 days' notice for foreign service officers.
Similar rule changes were made last month for civil service employees, allowing greater control over who gets laid off.
Layoffs by the Numbers:
Estimated 3,400 employees impacted
300+ offices to be consolidated or eliminated
2,000+ employees could still face involuntary RIFs
Of those, about 700 foreign service officers in domestic roles could be cutānearly 60% of that group.
The American Foreign Service Association blasted the changes, calling them reckless and ill-timed.
šJudge Halts Trump
Federal employees just won a critical pause in the fight to preserve their collective bargaining rights.
A federal judge in San Francisco has issued a preliminary injunction blocking 21 agencies from enforcing an executive order that stripped union representation rights from roughly 1 million federal workers.
President Trump signed an executive order in March barring collective bargaining at agencies he claimed were central to national security.
But Judge James Donato ruled this week that Trumpās order went far beyond precedent, applying the national security label to entire cabinet departments with little justification.
The court found that selective enforcement of the executive order raised red flags. Some agencies were allowed to maintain union agreements, while others werenāt often depending on whether their unions had criticized the administration.
A previous appeals court ruling allowed the administration to move forward with the executive order but said CBAs couldnāt be terminated during litigation.
Despite this, Judge Donato noted that some agencies have already begun terminating agreements, prompting his decision to preserve the status quo.
The injunction blocks enforcement of the order while the legal challenge proceeds to trial.
